Terms of Service

These Terms of Service ("Terms") govern your use of the VisualizeDom Photography website and any sports, event, and portrait photography services provided by VisualizeDom Photography ("VisualizeDom," "we," "us," or "our"). By booking a session, purchasing photos, or using this website, you agree to these Terms. If you do not agree, please do not use our services.

1. Services

VisualizeDom Photography provides sports, event, and portrait photography and visual content services in the Pittsburgh, PA area. Specific deliverables (session length, number of edited photos or videos, delivery format, and turnaround time) are described at the time of booking through Square or by written agreement.

2. Bookings, Deposits & Payment

• Sessions are scheduled through our Square booking page.
• A non-refundable retainer may be required to secure the date and time.
• The remaining balance is due on or before the session date unless otherwise agreed.
• Prices in effect at the time of booking apply to that booking.
• Late payments may delay delivery of edited galleries.

3. Cancellations & Rescheduling

Cancellations and rescheduling are handled under our Cancellation Policy. Please review it before booking.

4. Client Responsibilities

• Arrive on time and ready for the session.
• Provide accurate event, roster, and jersey information for sports shoots.
• Obtain any venue permissions or access we need to photograph the event.
• Ensure all participants (or their guardians) are aware they will be photographed.

5. Copyright & License

VisualizeDom Photography owns the copyright to all images we create. Upon full payment, clients receive a limited, non-exclusive, non-transferable license to use delivered photos for personal, non-commercial purposes — including printing, sharing on personal social media, and posting to family accounts.

The following are not permitted without prior written consent:

• Commercial use, resale, or licensing of the images.
• Use by third-party brands, sponsors, agencies, or news outlets.
• Substantial editing, filtering, or cropping that alters the original artistic work.
• Removing watermarks or credit lines when present.

Please credit "VisualizeDom Photography" or tag @visualizedom when sharing our images on social media. It is appreciated and helps support the business.

6. Model Release & Portfolio Use

Unless you request otherwise in writing before your session, you grant VisualizeDom Photography a perpetual, royalty-free right to use the images we create for our portfolio, website, social media, advertising, and other promotional materials. You may request removal of a specific image from our public marketing at any time by emailing us, and we will honor reasonable requests promptly.

7. Gallery Delivery & Availability

• Event galleries are typically delivered within 2–4 days of the session date.
• Sports galleries are typically delivered within 1–4 days of the shoot date, depending on the size of the shoot.
• Event galleries remain online for approximately six weeks.
• Sports galleries remain online longer, at our discretion.
• Clients are responsible for downloading and backing up their favorite images before galleries close. Re-uploads after archive may incur a fee.

8. Prints & Products

Prints and products are produced through Pic-Time's professional print labs. Colors may vary slightly between screens and printed materials. Print sales are final unless the product arrives damaged or defective.

9. Creative Control

VisualizeDom Photography reserves final creative discretion over image selection, editing style, color grading, and retouching. We do not release unedited RAW files.

10. Third-Party Platforms

Booking, payments, and gallery hosting are provided by Square and Pic-Time. Their respective terms and privacy policies also apply to your use of those platforms.

11. Liability

To the fullest extent permitted by law, VisualizeDom Photography's total liability for any claim arising out of a session or these Terms is limited to the amount actually paid by the client for that session. We are not responsible for delays, missed shots, or losses caused by circumstances beyond our reasonable control, including weather, event cancellation, venue access denial, equipment failure, illness, or acts of third parties. We do not guarantee specific shots, expressions, or plays, but we will use our professional skill and best efforts to deliver quality work.

12. Indemnification

You agree to indemnify and hold VisualizeDom Photography harmless from any claims, damages, or expenses arising from your breach of these Terms or your misuse of delivered images.

13. Website Use & Photo Protection

You may not use this website in any unlawful manner, attempt to disrupt its operation, or copy substantial portions of its content without permission.

The photographs displayed on this website are protected by United States copyright law and international treaties. Visitors may not download, copy, screenshot, reproduce, distribute, display, or create derivative works from any images on this site without prior written permission from VisualizeDom Photography. Technical measures such as disabled right-click, disabled printing, and disabled image copying are used to protect the gallery. Circumventing these measures is a violation of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the site or services constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Allegheny County, Pennsylvania.
